FERC Approves Entergy Mississippi’s Acquisition of the Choctaw Generating Station.

On September 19, 2019, the Federal Energy Regulatory Commission approved Entergy Mississippi’s proposed purchase of the Choctaw Generating Station.  EI Principal Dr. John R. Morris testified that the Commission’s default geographic market of MISO South was too small and that market concentration was low in the proper geographic market.  The Commission concluded that “based on the evidence in the record, we agree with Applicants that MISO South currently is not a relevant geographic market for purposes of evaluating the Proposed Transaction’s effect on competition and will not be considered a submarket.”  Steptoe & Johnson LLP represented Entergy Mississippi before FERC.
