In ruling reversing class certification, Circuit Court adopts arguments made by EI Special Consultant Bruce Owen.

On April 3, 2008, the Second Circuit issued an opinion reversing a district court ruling certifying class in Barbara Schwab et al. v. Philip Morris USA, Inc. et al. The alleged class included all persons who smoked “light” cigarettes in the U.S. since 1971. The plaintiffs were seeking $800 billion (trebled) in damages under RICO. Bruce Owen submitted an expert report analyzing class and damages issues on behalf of defendant cigarette companies. The Circuit Court’s decision adopted arguments first made in Dr. Owen’s expert report. Bruce Owen was assisted by EI Senior Vice President Kent Mikkelsen and Senior Economists Gale Mosteller and Su Sun.
